Charge: 3rd offense OWI appeal

Our client had two prior drunk driving convictions in other states and was convicted of a third offense OWI in Wisconsin when he was represented by another attorney. Attorney Tracey Wood argued that the out-of-state convictions should not have counted against the client. The Wisconsin Court of Appeals agreed and overturned the conviction.

Charge: OWI appeal

The client was represented by a different attorney and was convicted of OWI after the arresting officer testified that he had crossed the lane line. Tracey Wood argued in front of the Wisconsin Court of Appeals that the stop was illegal and that the evidence gathered was therefore inadmissible. The Court agreed and the conviction was reversed.

Charge: OWI appeal

Our client had been convicted of OWI after being represented by another attorney. Tracey Wood was successful in having the client’s conviction overturned and was also able to secure a plea bargain. The client pled to a lesser charge of reckless driving.

Result: Conviction overturned; charges reduced to reckless driving

Charge: Sex offense appeal

The client was convicted of sex crimes in two separate counties. He had instructed his attorney to file an appeal; however, the attorney did not do so which resulted in the client losing his right to an appeal. Attorney Adam Nero petitioned for a writ of habeas corpus to begin the appeals process. The writ was granted.

Result: Writ of habeas corpus granted

Charge: Child sex crime appeal

The client had pled guilty to using a computer to facilitate a child sex crime. However, the client used a cell phone in the commission of this crime rather than a computer. His attorney was unaware of a recent case that defined how cell phone usage in such instances impacts conviction. Attorney Adam Nero filed a motion for post conviction relief, which was granted by the court. The prosecutor offered to reduce the client’s prison sentence.

Result: Client’s prison sentence reduced by one year

Charge: Sexual offense appeal

This client had been convicted on charges of a sexual offense involving a child. Tracey Wood appealed the conviction, based on the ineffective assistance of the client’s previous attorney. Tracey won the appeal and the client was released from prison.
